[ Litigation ] as a Related Elective for those interested in Legal Theory : Students interested in business litigation as well as those who anticipate practicing transactional law will benefit from a review of the theoretical basis for private contract law. This course should also be useful for students interested in policy issues related to the enforcement of contracts. General course Description: This seminar will consider the institution of private contracting from multiple academic perspectives, including law and economics, law and philosophy and law and society. Possible topics to be covered include the theoretical bases for enforcing contracts; designing default rules; using contract rules for distributional ends; contract interpretation; disclosure of information; regulating standard form contracts; enforcement of contracts; and extralegal contractual relations. Course Style: A Substantive/ Perspective course looks at law from an external or non-traditional standpoint. Course Frequency: Offered once a year |
