[ Transactional ] as a Related Elective for those interested in Civil Liberties : An in-depth understanding of the First Amendment and related case law is important for lawyers whose clients have an Internet presence. These could be media and entertainment companies whose content is delivered over the Internet as well as other individuals and enterprises whose privacy or business reputation (such as trademarks or goodwill) may need legal protection. Cyberlaw cases frequently involve conflicts between privacy and free speech values. This course considers multiple perspectives from the various participants in our democracy. General course Description: A survey of First Amendment law, including a close study of text, the drafting and ratification process, and the development of modern First Amendment theory. The course will explore the multiple participants in the speech process, including the speaker, hearer, publisher, target and regulator, and ask why the law favors certain participants over others. The evolution of Supreme Court case law will be analyzed historically, with special emphasis on the relationship between free speech and democracy, Course Style: A Substantive course teaches the law, theory, and policy in a particular area of law Course Frequency: Offered once a year |
