Beginning with the choice of applicable law in cases where facts touch more than one jurisdiction, this course explores the variety of theories and systems used to resolve this question. General course Description: Cross-border civil litigation (interstate as well as international) can give rise to three major issues, adjudicatory jurisdiction, choice -of -law and enforcement (recognition) of judgments. The course will consider these issues and explore the various theories that developed in respect of each. Course Style: A Substantive course teaches the law, theory, and policy in a particular area of law Course Frequency: Offered every other year |
