[ Litigation ] as a Foundational Course : Understanding the themes of land use planning and land use control are important to an environmental lawyer. Particularly those students considering a career that focuses on conservation and natural resources should take this course. It explores whether or not the legal system should rely on the private property market or on comprehensive planning and regulation to accommodate conflicts over land use. The debate between a private market and a regulatory solution considers which decisions should be made by private owners and which by the government. The course also considers how these decisions affect environmental quality. General course Description: This course focuses on the pragmatic (rather than theoretical) aspects of contemporary land use law and policy, including: nuisance as a land use tool and foundation for modern land use law; use and abuse of the "police power" (the legal basis for land use control); zoning flexibility; vested property rights, development agreements, and takings; redevelopment; growth control; and direct democracy. We explore how land use decisions affect environmental quality and how land use decision-making addresses environmental impacts.
